TERMS AND CONDITIONS
AIHL Most Dangerous Man Competition
 

1. Information on how to enter form part of these terms and conditions.
2. Entry is open to all Australian Residents. Employees and the immediate families of the Promoter and agencies associated with this promotion are ineligible to enter. This includes contractors, agents and their immediate families and other party if applicable.
3. The competition commences at 9am (AEST) on Wednesday, 26 August 2015 and closes at 11pm (AEST) on Friday, August 28^th (the Promotional Period).
4. To enter participants must visit the promotion entry page at http://www.facebook.com/theaihl during the Promotional Period and add a comment to the post- tell us in 25 words or less ‘Which AIHL player is the most dangerous in the league and why?’  All entrants must be available to take the prize as stated and on the dates outlined in condition 11 (Eligible Entrant). If the winner is unable to take the prize as stated the prize will be forfeited and another winner will be drawn.
5. Entries that are, or include, obscene, offensive, defamatory, inappropriate, unsuitable, or infringing content as determined by the Promoter at its sole discretion will be deemed invalid and are not eligible to win. Incomplete or incomprehensible entries will also be deemed invalid.
6. This is a game of skill and chance plays no part in determining the winner. Each valid entry will be individually judged a panel of judges (made up of representatives of the Promoter) based on literary and creative merit, brevity and originality as determined by the panel of judges.  Promoter's decision in this matter is final and no correspondence will be entered into.
7. There will be one prize winner.
8. The winner will be notified via phone, via email, or Facebook message on Saturday, August 29^th. Winner’s name will be published on the AIHL website www.theaihl.com for a two (2) week period from the date of the prize draw. The Judge’s decision is final and no correspondence will be entered into.
9. If the winner cannot be contacted by the Promoter a second judgement will take place at 9am on Saturday, September 12^th in the Administration and Management Office of the AIHL. The new winner, based on the second judgement by the same panel of judges, will be notified via phone, email or Facebook message and this new winner’s name will be published on the AIHL website www.theaihl.com for a three (3) month period from the date of the second judgement.
10.  The prize winner will win the following: Haigh and Hastings M2 Diver watch.
11. The maximum total cash value of the overall prize is approximately $588. The value of the prize is accurate as at 25 August 2015 and the Promoter is not responsible for any variation to the value of the prize.
12. The prize winner is responsible for all costs not expressly listed in paragraph 10 including without limitation, entertainment, gratuities, other travel, other ground transportation to activities outside set competition activities, visas, passports, travel insurance excesses, extra meals and drinks, items of a personal nature, hotel incidentals such as telephone, internet, mini bar, laundry, fax and room service, freights, excess baggage, government taxes, any tax liabilities, airline and airport charges, any applicable surcharges and any other related costs.  Any transfers (domestic or international) are the responsibility of the prize winner.
13. The prize winner (and any companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The prize winner (and any companion) must ensure that these documents are in order and valid before departure and pay any additional costs incurred as a result of failure to comply with such requirements.  The prize winner (and any companion) must depart from and return to the same departure point and travel together at all times. Frequent flyer points will not form part of the prize. Winner may be required to present credit card at time of accommodation check in.  Prize travel is subject to the General Conditions of Carriage of the airlines.  Tickets will not be exchanged for another destination.
14. If for any reason the winner does not take a prize or an element of a prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.  The winner cannot on sell the prize. The Promoter’s decision is final and binding – no correspondence will be entered into. The Promoter accepts no responsibility for lost or misdirected entries. Incomplete or indecipherable entries will be deemed invalid.
15. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. Stated prize values are the recommended retail value (including GST) in Australian dollars as provided by the supplier and are correct at the time of printing. 
17. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the Promoters reasonable requirements. The winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
18. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
19. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
20. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. The prize is not redeemable for cash and is not transferable.
21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
22. Entrants must only enter in their own name. The Promoter reserves the right to request the winners to produce appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity, age, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
23. All entries become the property of the Promoter.  As a condition of entering into this promotion, entrants agree to assign all of their rights, title and interest (including copyright and any other intellectual property rights) in and to their entry and any other material submitted as part of or in connection with an entry (the Material) to the Promoter and consents to the Promoter using the entry and Material in any manner the Promoter wishes (including modifying, adapting or publishing the entry and Material in whole or in part or not at all), by way of all media, including, without limitation, commercialising any design or intellectual property in the Material, posting their entry and Material (whether in original form or a modified or adapted by the Promoter as permitted under this paragraph) on the Promoter’s website without payment to the entrant (of royalties, compensation or otherwise). Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant, which does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty and consents to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize. The entrant agrees not to bring any claim or proceeding against Promoter (including its officers, employees and agents) for any damage, loss, injury or liability you may suffer in participating in this competition or otherwise connected with you accepting and performing the prize.
25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products, services or events supplied or conducted by the Promoter.
26. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. By entering this competition, the entrant further acknowledges and agrees that the Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. 27. Any term in these Terms and Conditions that is either wholly or partly unenforceable will be severed to the extent necessary to make the remaining terms of these Terms and Conditions enforceable.
